These terms are an agreement between you and Severed Inc. ("Severed", "we", "us"). They cover everything we run: the website and online store at severedcircuits.com, Backstage (our support and community forum at backstage.severedcircuits.com), Severed Cloud at cloud.severedcircuits.com, the Axion hardware and its software updates, and our desktop and mobile companion apps (together, "the services"). By using the services, you agree to these terms and to our Privacy Policy.
Your Account
- You must be at least 13 years old to use the services.
- One account per person. Your account signs you in to both Severed Cloud and Backstage.
- Give us accurate details and keep your password safe. You are responsible for what happens under your account.
- Your @handle is public. Pick one that does not impersonate anyone or break these terms.
Content You Upload
You keep ownership of the rigs, amp models, impulse responses, presets, plugins, backing tracks, posts and anything else you upload or post.
By uploading or posting, you give Severed a worldwide, non-exclusive, royalty-free licence to host, store, copy, display and distribute that content through the services, so that we can show it to others and deliver it to the people and units that download it. This licence lasts while the content is on the services, and continues for copies other people already have.
Only upload what you have the right to share. Do not upload anything that infringes someone else's copyright, trademark or other rights.
We may remove content, or limit an account, when it breaks these terms or the law. If you believe something on the services infringes your rights, email us and we will look into it.
Content shared by other people is theirs, not ours. Use it at your own risk and respect any terms its author attaches to it.
Acceptable Use
Do not:
- harass, threaten or abuse other people;
- upload malware or anything designed to harm devices, data or the services;
- scrape, crawl or bulk-download the services, or overload them;
- try to get into accounts, systems or data that are not yours;
- circumvent or tamper with the security of the Axion unit or its software updates;
- use the services for anything illegal.
Purchases
Prices, taxes and shipping are shown in the store at checkout. Returns and refunds follow the store's return policy, and the Axion hardware is covered by its limited warranty policy. If the store shows a price in error, we may cancel the order and refund you.
Our Software
The software on the Axion unit, in our apps and on our websites is licensed to you, not sold. You may use it with your Axion and our services for your own use. You may not copy, resell, or reverse engineer it except where the law allows. Open-source parts are covered by their own licences, which take priority for those parts.
We release software updates to fix problems and add features. Updates may be downloaded and installed automatically. Third-party plugins you install are covered by their makers' terms, not ours.
Disclaimer and Limitation of Liability
THE SERVICES AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND BEYOND THOSE IN OUR HARDWARE WARRANTY POLICY OR REQUIRED BY LAW. WE DO NOT PROMISE THE SERVICES WILL ALWAYS BE AVAILABLE OR ERROR-FREE, OR THAT YOUR CONTENT WILL NEVER BE LOST.
TO THE EXTENT THE LAW ALLOWS, SEVERED IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR FOR LOST DATA OR PROFITS, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
Some places do not allow these limits, so they may not all apply to you.
Ending Your Use
You can stop using the services and delete your account at any time from your account page. We may suspend or close an account that breaks these terms or the law, or to protect other people or the services. The sections on content licence, disclaimer, liability and governing law continue after your account ends.
Governing Law
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA. Any dispute will be handled in the state or federal courts located in Pennsylvania, unless the law where you live gives you a different right.
Changes
We may update these terms. We will change the effective date above, and for significant changes we will tell you by email or on the services before they take effect. If you keep using the services after a change, you accept the updated terms.
